Article 1 (Purpose)
These terms and conditions aim to establish detailed implementation and compliance matters for domestic travel contracts concluded by Orcar and Jeju Plus, Rainbow Car Rental, Family Car Rental travelers.
Article 2 (Obligations of Travel Service Provider and Traveler)
The travel service provider must faithfully perform their assigned duties in the establishment and execution of travel plans, including travel arrangement, guidance, transportation, and accommodation, to provide safe and satisfactory travel services to travelers.
Travelers must actively cooperate in promoting harmony among travelers and maintaining travel order by the travel service provider for safe and enjoyable travel.
Article 3 (Types and Definitions of Travel)
The types and definitions of travel are as follows:
• Customized Travel: Travel conducted by the travel service provider according to the travel conditions desired by the traveler
• Group Travel: Travel conducted by recruiting travelers according to travel conditions established by the travel service provider
• Consigned Travel: Travel conducted by entrusting the recruitment of travelers for group travel products created by the travel service provider to other travel companies
Article 4 (Contract Composition)
The travel contract consists of the travel contract form (attachment), travel terms and conditions, and travel itinerary (or travel description).
The travel itinerary (or travel description) must include daily travel destinations, tourism content, transportation, shopping frequency, accommodation, meals, and other travel implementation schedules, travel company service content, and traveler precautions.
Article 5 (Special Agreements)
The travel service provider and traveler may enter into special agreements in writing within the scope that does not violate relevant laws and regulations. In this case, the travel service provider must explain to the traveler how it differs from the standard terms and conditions.
Article 6 (Delivery of Contract Documents and Terms)
When the travel service provider concludes a travel contract with a traveler, they must deliver one copy each of the contract document, travel terms and conditions, and travel itinerary (or travel description) to the traveler.
Article 7 (Deemed Delivery of Contract Documents and Terms)
In the following cases, the travel service provider shall be deemed to have delivered the travel contract document, travel terms and conditions, and travel itinerary (or travel description) to the traveler:
• When the traveler agrees to the content of the travel contract document, terms and conditions, and travel itinerary (or travel description) provided through the internet or other electronic information networks and applies for the conclusion of a travel contract, and the travel service provider notifies the traveler of acceptance through electronic information networks or mechanical devices
• When the traveler agrees to the content of the travel contract document, terms and conditions, and travel itinerary (or travel description) provided by the travel service provider using facsimile or other mechanical devices and sends a written application for the conclusion of a travel contract, and the travel service provider notifies the traveler of acceptance through electronic information networks or mechanical devices
Article 8 (Travel Service Provider's Responsibility)
The travel service provider shall be liable for damages caused intentionally or negligently to travelers by the travel service provider themselves or their employees, local travel service providers or their employees (hereinafter referred to as "agents") in connection with the travel service provider's duties stipulated in Article 2, Paragraph 1, from the time of travel departure to arrival.
The travel service provider must compensate for damages incurred by travelers due to delays or early departures of transportation such as aircraft, trains, ships, or traffic congestion. However, this shall not apply when the travel service provider proves that they had no intention or negligence.
The travel service provider must compensate for damages caused by loss, damage, or delay of traveler's luggage unless they can prove that they or their agents did not neglect their duty of care regarding the receipt, delivery, and storage of traveler's luggage.
Article 9 (Contract Cancellation When Minimum Participants Not Met)
When the travel service provider cancels the travel contract due to insufficient minimum participants, they must notify the traveler at least 24 hours before travel departure for same-day travel, or at least 48 hours before travel departure for trips of one night and two days or more.
If the travel service provider cancels the contract without providing notice within the time limits specified in the previous paragraph due to insufficient participants, they must compensate the traveler with an amount equivalent to 100% of the contract deposit in addition to refunding the already paid contract deposit.
Article 10 (Contract Refusal)
The travel service provider may refuse to conclude a contract with a traveler if any of the following reasons apply:
• When it is deemed that the traveler would cause inconvenience to other travelers or interfere with the smooth implementation of the travel
• When it is deemed that travel is difficult due to illness or other reasons
• When the maximum number of participants specified in the contract has been exceeded
Article 11 (Travel Fees)
The basic fee includes the following items. However, for customized travel, this shall be subject to agreement between the parties:
• Transportation fares for aircraft, ships, railways, and other transportation (based on regular fares)
• Transfer bus fares between airports, stations, ports, and hotels
• Accommodation and meal fees
• Guide expenses
• Various taxes required during travel
• Domestic airport and port usage fees
• Entrance fees to tourist attractions in the itinerary
• Other costs according to individual contracts
The traveler must pay a contract deposit (up to 10% of the travel fee) to the travel service provider when concluding the contract, and the contract deposit shall be treated as all or part of the travel fee or damage compensation.
The traveler must pay the balance of the travel fee, excluding the contract deposit, to the travel service provider by the day before travel departure.
The traveler must pay the travel fee through the method designated by the travel service provider (bank transfer, direct deposit, etc.).
When traveler insurance premiums are included in the customized travel fee, the travel service provider must explain the insurance company name, compensation details, etc. to the traveler.
Article 12 (Requirements for Changing Travel Conditions and Settlement of Fees)
The travel conditions of Articles 1 through 11 may be changed only in the following cases:
• When both parties agree that it is unavoidable due to the traveler's request or local circumstances for the safety and protection of the traveler
• When the travel purpose cannot be achieved due to natural disasters, war, government orders, strikes or closures of transportation or accommodation facilities
When increases or decreases in travel fees under Article 11, Paragraph 1 occur due to changes in travel conditions under Paragraph 1, changes made before travel departure must be settled (refunded) before travel departure, and changes made during travel must be settled (refunded) within 10 days after travel completion.
When damage compensation amounts arise due to changes in travel conditions not in accordance with Paragraph 1 or contract cancellation/termination under Articles 13 or 14, amounts incurred before travel departure must be settled (refunded) before travel departure, and amounts incurred during travel must be settled (refunded) within 10 days after travel completion.
If a traveler cannot receive services included in the travel fee such as accommodation, meals, or sightseeing due to their own circumstances after travel departure, they cannot claim a refund of the corresponding fee from the travel service provider. However, if the travel is terminated midway, it shall be handled according to Article 14.
Article 13 (Contract Cancellation Before Travel Departure)
The travel service provider or traveler may cancel this travel contract before travel departure. In this case, the damage amount incurred shall be compensated according to the "Consumer Damage Compensation Regulations" (Ministry of Finance and Economy Notice).
The travel service provider or traveler may cancel this travel contract before travel departure without paying the damage compensation amount under Paragraph 1 to the other party if any of the following reasons apply:
Cases where the travel service provider may cancel:
• Cases under Article 12, Paragraph 1, Items 1 and 2
• When the traveler is deemed to cause inconvenience to other travelers or significantly interfere with the smooth implementation of the travel
• When the traveler's physical condition, such as illness, makes participation in travel impossible
• When the traveler does not pay the travel fee by the date specified in the contract
Cases where the traveler may cancel:
• Cases under Article 12, Paragraph 1, Items 1 and 2
• When a relative within the third degree of kinship of the traveler dies
• When the traveler's physical condition, such as illness, makes participation in travel impossible
• When a spouse or direct ascendant/descendant is hospitalized for 3 or more days due to physical condition and discharge is difficult by travel departure time - one spouse or guardian
• When travel implementation according to the travel itinerary specified in the contract becomes impossible due to the travel service provider's fault
Article 14 (Contract Termination After Travel Departure)
The travel service provider or traveler may terminate this contract after travel departure if there are unavoidable reasons. However, they must compensate for damages incurred by the other party.
When the contract is terminated according to Paragraph 1, the travel service provider must cooperate in matters necessary for the traveler's return home, and costs necessary for this that are not due to the travel service provider's fault shall be borne by the traveler.
Article 15 (Start and End of Travel)
Travel begins from the moment of departure and ends simultaneously upon arrival at the final destination when the travel itinerary is completed. However, this is subject to exceptions when contracts and itineraries are changed.
Article 16 (Duty to Explain)
The travel service provider must explain the important content stipulated in these terms and conditions and any changes thereto in a manner that travelers can understand.
Article 17 (Insurance Subscription)
The travel service provider must subscribe to insurance or mutual aid to pay insurance benefits to travelers in case of damages occurring to travelers in connection with travel, or deposit business guarantee money.
Article 18 (Other Matters)
For matters not specified in this contract or disputes regarding the interpretation of this contract, the travel service provider and traveler shall decide by mutual agreement, and if no agreement is reached, it shall be governed by relevant laws and general practices.
For travel to special areas where there are justified reasons, the content may be different from these terms and conditions.
